Helpful Resources

To find additional resources regarding your employee rights, the following websites may be helpful:

Federal and State Resources for Unlawful Discrimination and Retaliation

Prior to initiating a wrongful termination lawsuit based on unlawful discrimination or retaliation, you have to file a Complaint with either the Equal Employment Opportunity Commission (EEOC) or the California Civil Rights Department (CRD) to obtain a Right to Sue Letter. We strongly advise that you retain an attorney to assist you with this process and prepare the Complaint. This process requires you disclose information about your potential case.

You should not make statements about your case without legal representation. The Complaint must be signed under penalty of perjury and forms a basis of your lawsuit. The manner in which statements are made or left out may leave room for an employer to misconstrue your statements or intentions. Leaving out important information or oversharing may place you at a disadvantage. There are many nuances in employee rights law that must be considered.

We assist clients throughout this process to ensure that all steps are properly completed. Failure to properly complete this process may also preclude you from pursuing all of the claims you may have. If you are considering submitting your case to the EEOC or the CRD, please contact us for a free consultation.

State Resources for Wage and Hour Violations

California is generally more favorable towards employees than federal law and may provide more avenues for obtaining earned wages. You may pursue an unpaid wage claim either by filing a Complaint with the California Labor Commissioner’s Office or filing a lawsuit in Court or private arbitration. There are benefits and disadvantages that may apply to each course of action. Hence, it is a good idea to discuss your claims with an attorney to help determine a proper course of action.

State Resources for Workplace Safety

The Division of Occupational Safety and Health (DOSH), better known as Cal/OSHA, serves to protect and improve the health and safety of working men and women in California. It is responsible for setting and enforcing standards, among other crucial duties. If you suspect a Cal/OSHA violation in the workplace, please reach out to us first for a free and confidential consultation.

Cal/OSHA also provides helpful information about requesting benefits for a workplace injury.

Retaliation for complaining of health and safety violations in the workplace is illegal.

Reporting Patient Safety Complaints

The California Department of Public Health provides information about filing a Complaint against health care facilities. Any person can file a complaint against any health care facility whether it is as large as Cedars-Sinai Medical Center or a solo medical practice. A patient, a facility resident, an employee or a friend or general member of the public can file a complaint.

If you are retaliated or discriminated against for advocating for patient rights internally or externally, please contact us to discuss your situation.

The Los Angeles Law Library

This Library was created to provide legal materials to the public and self-represented litigants and houses a broad collection of Federal and State legal resources.
